WYNN VACATIONS PUBLIC CHARTER OPERATOR-PARTICIPANT CONTRACT



This agreement sets forth the terms and conditions under which we, LAS VEGAS JET LLC (DBA Wynn Vacations) 3131 Las Vegas Blvd, Las Vegas, NV 89109, in return for payment of the amount indicated as the total charter price, agree to provide you this charter flight. The US Department of Transportation requires all passengers to agree/accept/sign the terms of the Operator Participant Agreement at the time of payment.

RESPONSIBILITY: We, as the principal, are responsible to you for arranging and providing all of the services and accommodations offered in connection with these charter flights, provided, however, that in the absence of negligence on our part, we are not responsible for personal injury or property damage caused by the air carrier, or other suppliers of any of the services being offered in connection with the charter.

RESERVATIONS AND PAYMENT: The total price paid in full per passenger and a signed contract (see attached reservation form) is required to secure reservations. Passengers have a right to a copy of this agreement prior to making payment. American Express complimentary room upgrade subject to availability. ALL CHECKS, MONEY ORDERS, AND CREDIT CARD PAYMENTS MUST BE MADE PAYABLE TO WYNN VACATIONS / HARLEYSVILLE NATIONAL BANK.

CHARTER PRICE: The quoted charter price includes charter air transportation for the Charter Flight booked with Wynn Vacations’ Reservations Department. Fares include 7.5% Federal Excise Tax, September 11th security fees of $2.50 per person per enplanement, Federal Flight Segment Taxes of $3.60 per person per flight segment, and Passenger Facility Charges (PFC) of up to $4.50 per person per enplanement. Charter prices do not include hotel occupancy taxes of 12% applicable to the hotel portion of the tour itinerary. The hotel portion of the lowest priced packages is $400. The charter price also includes ground transportation directly to and from the private air terminal in Las Vegas, two nights of hotel accommodations at Wynn Las Vegas, baggage handling directly to your room and complimentary one-time access to nightclubs, Tryst, Blush or XS on Friday night. Guests are responsible for costs incurred at the nightclubs, and must be present at the location at 10pm to redeem complimentary nightclub access. Rates do not include any guest expenses such as meals, shows, gratuities, and other incidentals that are the responsibility of the guest. Any tips or gratuities not specifically mentioned as included in the total charter price will be at your discretion.

BAGGAGE: Wynn Vacations will transport up to two checked bags weighing a combined total of no more than 50 pounds free of charge. Cabin space dedicated to luggage is limited. Carry-on items are limited to ONE small personal item per person (including purses, laptops, and briefcases). Personal items must fit in the overhead storage bins. Dimensions for the overhead bins are: 9 inches in height 17 inches deep 45 inches wide. Special arrangements with the concierge are required for large bags or baggage weighing over 50 lbs. In accordance with federal regulations, air carrier liability for lost, stolen, pilfered, or damaged bags in the carriage of passenger baggage is limited to provable damage not exceeding $3,300 (provided the passenger provides Wynn Vacations with the baggage service report and suitable evidence of the value of the bag and its contents).

AIRCRAFT: This flight will be performed by ExpressJet Airlines, Inc. using a 50-seat Embraer Model 145 aircraft. Wynn Vacations reserves the right to substitute equivalent aircraft if necessary.

CHECK IN: All passengers must present themselves at the airport registration desk inside the terminal no later than 45 minutes prior to departure for check in. Wynn Vacations reserves the right to deny boarding to any passenger that fails to check in at least 45 minutes prior to departure.
SECURITY AGREEMENT: Your payments are protected in part by a surety trust agreement that we have obtained from National City Bank 775 West Big Beaver Rd., Ste. 1400 Troy, MI 48084. Unless you file a claim with us, or, if we are not available, with the securer within 60 days after the completion of the charter, the securer will be released from all liability to you under the security agreement

CANCELLATION AND REFUNDS: Once purchased the Charter Price, including the value of the included hotel accommodations, is non-refundable The right to a refund of a Charter Flight, if changed, is limited but includes the following rights: a) participants who pay by a credit card may receive a full refund until a operator-participant contract is signed. B) Participants may receive a full refund, less a $25 administrative fee, upon providing a substitute Participant to Wynn Vacations or upon Wynn Vacations finding a substitute for you. If we make major changes prior to departure, YOU HAVE THE RIGHT TO CANCEL AND RECEIVE A FULL REFUND. The following are major changes: (1) a change in the departure or return date, unless the change results from a flight delay experienced by the air carrier. (If, however, the delay is longer than 48 hours, it will be considered a major change.) (2) a change in the origin or destination city, unless the change affects only the order in which cities named in a tour package are visited; If a major change must be made in the program, we will notify you within 7 days after first learning of the change, but in any event at least 10 days prior to the scheduled departure. If, less than 10 days before scheduled departure, we become aware that a major change must be made, we will notify you as soon as possible. WITHIN 7 DAYS AFTER RECEIVING NOTIFICATION OF A MAJOR CHANGE, BUT IN NO EVENT LATER THAN DEPARTURE, YOU MAY CANCEL YOUR RESERVATION AND YOU WILL RECEIVE A FULL REFUND WITHIN 14 DAYS AFTER CANCELING. If a major change occurs after the departure of the flight, which you are unwilling to accept, we will refund, within 14 days after your scheduled return date, that portion of your payment, which applies to the services, not accepted. IF WE MUST CANCEL THE CHARTER: WE WILL NOTIFY YOU IN WRITING WITHIN 7 DAYS OF THE CANCELLATION, BUT IN NO EVENT LATER THAN 10 DAYS BEFORE THE SCHEDULED DEPARTURE DATE. We have no right to cancel the charter less than 10 days before departure, except for circumstances that make it physically impossible to perform the charter trip. If that occurs, we will notify you as soon as possible, but not later than the scheduled departure date. If the charter is canceled, we will make a full refund to you within 14 days after cancellation. The rights and remedies made available under this contract are in addition to any other rights or remedies available under applicable law. However, we offer refunds under this contract with the express understanding that the receipt of that refund by a passenger waives the additional remedies.

MISCELLANEOUS: Offer is available from Burbank: Friday through Sunday only over the following dates: 1/8-10, 1/15-17, 1/22-24, and 1/29-31. Offer is available from Orange County: Friday through Sunday only over the following dates: 1/8-10, 1/15-17, 1/22-24, and 1/29-31. All offers are subject to availability. All passengers MUST have a government issued photo ID to board the aircraft. The price of the package is for a double occupancy room. The lowest single occupancy room is $799 plus tax. Room type upgrades may be requested pending availability. Guests are responsible for following all package instructions as noted in the letter presented upon check-in. Consecutive reservations may not be booked for this promotion. Offer is not valid for any group bookings, conventions or existing reservations and is available for purchase on a one-time only basis. A valid credit card authorized to cover room tax plus $200 a night for incidentals must be presented upon check-in. Participants and their guests must be at least 21 years of age. Wynn Vacations reserves the right to cancel, suspend, or modify this offer at its sole discretion. This offer is subject to all applicable federal, state, and local laws and regulations.
